
This policy covers Web sites owned or operated by New Jersey Audubon and the Cape May Bird Observatory (CMBO). This notice applies to all information collected by or submitted to the Cape May Bird Observatory’s birdcapemay.org and featheredgeoptics.org websites.
Your privacy is important to us. To better protect your privacy, we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.
We are dedicated to protecting your personal information, and will make every effort to keep that information secure. You can visit most portions of birdcapemay.org and featheredgeoptics.org without telling us who you are and without revealing any personal information.
We recognize that visitors to our site may be concerned about the information they provide to us and how NJ Audubon treats that information.
When birdcapemay.org or featheredgeoptics.org needs to collect personal information, a visitor to our site will be alerted and given the choice to voluntarily share or to not share information. On some pages, you can make requests, register to receive materials, register for programs or events, or order merchandise from our online nature store (FeatherEdge Optics). The types of personal information collected at these pages are: name, mailing address, e-mail address, phone number, credit/debit card information, membership status. On some pages, you can submit this personal information about other people. For example, if you order a gift membership online and want it sent directly to the recipient, you will need to submit the recipient's address.
We have made every effort to protect sensitive customer information by using the highest levels of encryption and security protocols available in the industry. If you are still concerned about the safety of your credit card information online, you may also submit contributions or other payment to NJ Audubon and/or CMBO via phone order or by mailing a check as directed by the order instructions on the online nature store (FeatherEdge Optics) pages of our website.
We use the information you provide about yourself when becoming a member, making a gift, registering for a program or event, or placing an order only to complete that transaction. We do not share this information with outside parties except to the extent necessary to complete the transaction.
We use the information you provide about someone else when giving them a gift membership, making a tribute gift, registering that person for a program or event, or placing an order for them only to notify that person about the gift membership or tribute gift, that the program or event registration was made on their behalf, or to ship product and to confirm delivery. We do not share this information with outside parties except to the extent necessary to complete that transaction.
New Jersey Audubon and the Cape May Bird Observatory will not sell, trade or otherwise disseminate your email address or phone number to any other individuals or organizations. From time to time, we may elect to trade US Postal Service mailing lists with other non-profit organizations who share similar goals. However, that is the extent of the information we will share. We do not provide personally identifiable information to any commercial, for-profit organizations. We provide links to our sponsors and third party sites. NJ Audubon/CMBO encourages you to review the privacy policies posted on these third party sites as the NJ Audubon/CMBO Privacy Policy does not apply to these sites. The link from our websites to a third party site does not constitute an endorsement by birdcapemay.org or featheredgeoptics.org of the owner of the other site, the content of its site, or its products or services.

The Children's Online Privacy Protection Act of 1998 (COPPA) protects the personal information of children under the age of 13. This applies to individually identifiable information about a child that is collected online, including a first and last name, home or other physical address, email address, telephone number, social security number, hobbies or any other personal information that would allow someone to identify or contact the child. Note to Parents on Our Privacy Policy
NJ Audubon and the Cape May Bird Observatory is committed to providing a safe, secure, and fun online experience for children who visit our site, BirdCapeMay.org. We are dedicated to safeguarding any personal information collected online and to helping parents and children have positive experiences on the Internet. Consistent with the COPPA, we will never knowingly request personally identifiable information from anyone under the age of 13 without prior verifiable parental consent.
Parents are advised to read the BirdCapeMay.org privacy policy closely (as well as the policies of others sites your child may visit). A parent has the right to decide whether or not to give consent. Giving consent authorizes NJ Audubon / CMBO to collect personal information from your child.
When Consent Is Not Necessary:
- To collect a child’s email address to respond directly to a one-time request for information.
- For the sole purpose of obtaining consent from a parent.
- To provide notices to the parent.
- To ensure the safety of the child or the site.
- When online contact information collected from a child is used to resend, more than once, directly to a specific request from a child and it is not used to re-contact the child beyond the scope of the request. If, before any additional response after the initial response to the child, NJAS uses reasonable efforts to notify a parent of the contact information collected from the child, the purposes for which it is to be used, and an opportunity for the parent to request that NJAS make no further use of the information.
When Consent Is Necessary:
To request or to review personal information collected from children, we must verify the identity of the requesting parent. NJ Audubon / CMBO will contact the parent for consent by sending you a notice and request. To respect the privacy of parents, information collected and used for the sole purpose of obtaining verifiable parental consent will not be used for any other purposes.
A parent can at any time, revoke their consent and ask that information about their child be deleted from the site by contacting NJ Audubon / CMBO at 609.884.2736. When a parent revokes consent, we will stop collecting, using and/or disclosing information from that child.
It is NJ Audubon / CMBO’s policy not to collect more personally identifiable information from children under 13 than is necessary for them to participate in our online activities. BirdCapeMay.org does not use “cookies” and we do not pass personally identifiable information of children under 13 on to third parties.
Types of Information We Collect:
For purposes of the monthly photo quiz and the FAQ (frequently asked questions) page, BirdCapeMay.org may collect a child’s name, address, email address, phone number (for verifying parental consent) and information on their hobbies such as bird watching and other nature study. BirdCapeMay.org will only use a child’s individually identifiable information to respond to an inquiry or questions if asked, to submit entries to the photo quiz contest and to contact a contest winner who is eligible to receive a prize.
